1. Acceptance of Terms
These Terms & Conditions (the “Terms”) form a legally binding contract between you (the “Customer”, “User”, “you”) and Ace Communication, a company registered in Pakistan with its registered office at 1st Floor, Khayam Chambers, PECHS Block 2, Karachi (“Ace Communication”, “we”, “our”, “us”), governing your use of geomines.org and the GeoMine AI platform (collectively, the “Service”).
By creating an account, purchasing credits, uploading data or otherwise using the Service you confirm that you have read, understood and agreed to be bound by these Terms. If you do not agree, you must not use the Service.
2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into binding contracts in your jurisdiction. If you are using the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.
3. Description of the Service
GeoMine AI is a Software-as-a-Service (SaaS) platform that processes publicly available satellite imagery (Sentinel-2, Sentinel-1, ASTER, Landsat, SRTM and others), commercial high-resolution imagery (Planet Labs, where available), and large-language-model–generated geological narrative (Anthropic Claude) to produce mineral-prospectivity reports for user-defined areas of interest.
The Service includes, without limitation: 18 spectral indices, hotspot zone classification, aeromagnetic and gravity proxies, structural lineament detection, environmental risk assessment, drill-target recommendations, executive briefings and PDF reports in English and Chinese.
4. Account Registration & Security
- You must provide accurate and complete information when creating your account.
- You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.
- You must notify us immediately at info@geomines.org of any unauthorised use of your account.
- We may suspend or terminate accounts that show signs of fraud, abuse or violation of these Terms.
5. Payment, Pricing & Credits
- The Service is priced at PKR 100,000 / km² (≈ USD 357 / km²). Discounts may apply for institutional and bulk orders.
- Payments may be made via card, Raast, JazzCash, Easypaisa (PKR) or international card via Stripe (USD).
- Payments are processed by our payment partners PayFast (Pakistan, an SBP-licensed PSO/PSP) and Stripe (international). Their respective terms and privacy policies also apply.
- Credits expire 12 months from the date of purchase unless otherwise agreed in writing.
- All prices are exclusive of taxes unless explicitly stated. You are responsible for any taxes that apply to the transaction in your jurisdiction.
- Refunds and cancellations are governed by our separate Refund & Cancellation Policy.
6. Acceptable Use
You agree not to:
- Use the Service for any illegal, fraudulent or harmful purpose.
- Submit boundaries or coordinates that infringe the rights of any third party (including disputed mining concessions or restricted military areas where prohibited by law).
- Reverse engineer, decompile, scrape or attempt to derive the source code of the Service.
- Resell, sublicense, white-label or redistribute the Service or its outputs without our prior written consent.
- Use the Service to build a competing product.
- Upload viruses, malware or any code intended to damage the Service or other users.
- Attempt to bypass authentication, rate limiting, or other security measures.
7. Intellectual Property
7.1 Our IP
The Service, including its software, models, prompts, design, branding, documentation and report templates, is and will remain the exclusive property of Ace Communication and its licensors. Nothing in these Terms transfers any IP rights to you except the limited usage license below.
7.2 Customer data & outputs
You retain ownership of the boundaries, coordinates and any other input data you submit. We grant you a non-exclusive, worldwide, perpetual licence to use, copy, modify and distribute the PDF reports and dashboards we generate for your own internal business purposes, including sharing them with investors, regulators and partners.
You grant us a non-exclusive licence to use anonymised, aggregated metrics derived from your usage (number of analyses, average area size, etc.) to operate, improve and market the Service.
8. Geological Disclaimer (IMPORTANT)
GeoMine AI is an exploration-screening tool, not a substitute for ground survey, drilling or laboratory analysis. Satellite remote sensing detects spectral signatures consistent with certain minerals on or very near the surface (typically 0–5 m depth). The presence of a strong signal does not guarantee a commercially viable deposit, and the absence of a signal does not guarantee that no deposit exists. All investment, exploration or operational decisions must be confirmed with conventional geophysical surveys, drilling, geochemistry and qualified Competent Person assessment under JORC, NI 43-101 or an equivalent reporting code.
To the maximum extent permitted by law, Ace Communication accepts no liability for losses arising from reliance on GeoMine AI outputs without such independent verification.
9. Service Availability
We use reasonable efforts to keep the Service available 24/7 but do not guarantee uninterrupted operation. The Service may be unavailable from time to time for scheduled maintenance, force majeure events, third-party API outages (e.g. Google Earth Engine, Planet Labs, Anthropic), or security incidents. Please refer to our Service Delivery Policy for target turnaround times.
10. Disclaimers & Limitation of Liability
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
To the maximum extent permitted by applicable law, Ace Communication's total aggregate liability arising out of or relating to these Terms or the Service shall not exceed the total fees paid by you to us in the three (3) months immediately preceding the event giving rise to the claim. We shall not be liable for any indirect, incidental, special, consequential or punitive damages, lost profits, lost data, business interruption, or loss of goodwill.
11. Indemnification
You agree to indemnify and hold harmless Ace Communication, its directors, employees, agents and partners from any claims, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of (a) your breach of these Terms, (b) your misuse of the Service, or (c) your infringement of any third-party right.
12. Suspension & Termination
- You may close your account at any time by emailing info@geomines.org.
- We may suspend or terminate your account immediately if you breach these Terms, fail to pay an outstanding invoice, or use the Service in a way that creates legal, security or reputational risk for us.
- Sections that by their nature should survive termination (IP, disclaimers, limitation of liability, indemnification, governing law) will continue to apply.
13. Modifications
We may modify these Terms from time to time. Material changes will be notified by email at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you disagree, your sole remedy is to stop using the Service and (where applicable) request a refund of unused credits under the Refund Policy.
14. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, without regard to its conflict-of-law principles. The courts of Karachi, Sindh shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except that we may seek injunctive or equitable relief in any competent court to protect our intellectual property.
Before initiating litigation, the parties shall attempt in good faith to resolve any dispute by informal negotiation for at least 30 days following written notice.
15. Force Majeure
Neither party shall be liable for delay or failure in performance caused by events beyond its reasonable control, including acts of God, war, civil unrest, government action, internet or telecommunications failures, or epidemic / pandemic.
16. Severability & Entire Agreement
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force. These Terms, together with the Privacy Policy, Refund Policy and Service Delivery Policy, constitute the entire agreement between you and Ace Communication regarding the Service.
